PRESS RELEASE: NUMSA R800m tender case against City Power postponed until June 04
The matter between the National Union of Metalworkers of South Africa (NUMSA) and City Power that was to be heard at South Gauteng High Court in Johannesburg on Tuesday 28 May 2013 has been postponed until next week Tuesday 04 June 2013. NUMSA is taking City Power to court over Johannesburg municipal electricity utility's refusal to disclose information on the basis of which a R800-million tender for supply and installation of low pressure solar water geysers was awarded in May 2012.
After failing to file a notice of intention to oppose NUMSA's application as well as submitting an answering affidavit within 10 and 15-day time-frames that Rule 6(5)(b) and Rule 6(5)(d) of the Uniform Rules of Court, last week City Power suddenly indicated to the union's lawyers the electricity utility's plan to contest the NUMSA's decision to approach the court. "What has City Power to hide?" asked NUMSA's national treasurer Mphumzi Maqungo.
"In relation to the court, City Power is using the same delaying tactics that they have used against us since we requested the information on the tender in May 2012. The company's management have perfected the art of procrastination", says Maqungo
NUMSA will approach the Johannesburg Municipal Police Division (JMPD) so that the permit to picket outside the court that the union applied for is extended to next Tuesday 04 June.
